You may have heard news reports about fish oil supplements containing the chemical pollutants PCBs. One news report aired on ABC’s Good Morning America Wednesday morning and mentioned NOW Foods salmon oil and cod liver oil. This is the result of a lawsuit filed by the Mateel Environmental Justice Foundation and two individuals against NOW and 7 other defendants. They claim that we are in violation of a law in the state of California (Proposition 65) that requires manufacturers to place a warning label on products containing substances that could cause cancer and / or reproductive harm. Proposition 65 is an unusual law that applies to very small levels of chemicals – levels that in some cases are much lower than those permitted by other laws. This lawsuit claims that three of our fish oil products (Shark Liver Oil, Salmon Oil, and Double Strength Cod Liver Oil) exceed the limits under California’s Proposition 65 law. The plaintiffs in the lawsuit claim that our products tested for the presence of PCBs in very small amounts. Unfortunately PCBs are an environmental pollutant and are found virtually everywhere in nature. The levels of PCBs that were reported in the lawsuit were less than the limits that are allowed for a serving of fish. In other words, you will probably ingest more PCBs from eating fish than consuming fish oil capsules. In fact, you would probably need to ingest over 500 fish oil capsules to match the allowable limit for PCBs in a 4 oz. salmon filet. We feel that if the plaintiffs were really concerned about public health, they would be suing the fish industry or the environmental polluters! They would also not be discouraging people from taking fish oil capsules which is probably much safer tha! n eating fish. You can be assured that OUR PRODUCTS MEET ALL FEDERAL SAFETY STANDARDS. It’s important to note that all of our Omega-3 products are molecularly distilled. This process reduces potential contaminants that are common to fish such as PCB’s, heavy metals, mercury, dioxins and others. Advanced instrumentation, including HPLC, FTIR, ICP-MS and GC are used to measure potency and the presence of contamination. NOW disputes the allegations that these products are unsafe. Even though this is a small percentage of our fish oil sales we are still taking this matter seriously.
This is not the first time the Natural Products Industry and NOW have been confronted by a lawsuit under California Proposition 65. Obviously, we are concerned about the negative media coverage and the impact to the NOW brand. Ironically, two of our fish oil supplements are listed as a “Best Choice” by the Environmental Defense Fund for purity! Your customers may be concerned based on the news reports they’ve seen on TV or read in newspapers. Please help us educate them by explaining this issue to them. Q. I have a question about Now foods Inulin product. Do you know if they use any chemicals in the process of deriving the inulin from the chicory root? I understand that it's possible to do this with hot water alone, but that many manufacturers use a chemical process.
   A. This is a good question. You may wish to contact NOW Foods directly through their website.
      Q. I did contact someone at Now Foods regarding the NOW inulin product, and she was quite standoffish when I asked, mentioning something about "proprietary information". I explained patiently that I wasn't asking for any trade secrets - just whether they use water and enzymes or chemicals in their inulin extraction process. Then she said she would fax me something about their inulin manufacturing process, which she never did.


Q. I wanted to let you know that NOW Foods has SAM-e in a 100 mg dosage which is what you prefer patients to use.
